El artículo examina, críticamente, la solución que propone Ronald Dworkin para el problema de si los ideales políticos de libertad e igualdad entran en conflicto. El núcleo de mi crítica es que la solución de Dworkin depende de un supuesto dudoso, a saber: que no puede haber casos de colisión entre dos obligaciones de igual importancia. Siguiendo una idea de Ruth Marcus, afirmo, finalmente, que la existencia de dilemas valorativos genuinos no implica, como pretende Dworkin, tener que reconocer que (...) el sistema de principios del agente es internamente inconsistente, ya que esta clase de problema surge más bien de factores circunstanciales. The ‘Hart-miracle’, then the ‘Hart-phenomenon’ are analysed through surveying (1) the state of legal philosophising in England preceding Hart, (2) his professional career and (3) the early British reception of his work, including (4) the kinds of criticism as to its methodology and presuppositions as well as (5) its becoming a master type of jurisprudence with Oxford as a centre. Taking it as a mainstream, the continental tradition of encouragement to productive thinking characteristic even of Kelsenism is contrasted with its (...) worldwide reception, by the effect of channelling thinking. Its reception in Hungary with an overview of which trends of legal philosophising of the 20 th century has exerted or failed to exert an impact upon - as echoed by - theorising on law in Hungary is also considered. As concluded, the places in the imaginary Pantheon of 20 th -century legal philosophising occupied by Max Weber and Hans Kelsen (as accompanied by Eugen Ehrlich and Gustav Radbruch who are deemed to have been decisively significant minor masters), representing the first half of the century, are complemented indeed by the places occupied by H. L. A. Hart and Ronald M. Dworkin in representation of the second half of 20 th century. (shrink)

Although the general issue admits of different formulations with subtly different emphases, the characterization of it that will serve as my target focuses on “cross-worlds” luck, a kind of luck that arises when the decision-making of agents is indeterministic.

El artículo se constituye en una exploración del pensamiento de un escritor, pensador y activista afrocostarricense Dolores Joseph Montout, específicamente en relación con el Caribe. La reconstrucción de sus ideas se basó principalmente en su obra periodística en los años treinta, en The Searchlight y The Atlantic Voice, en los cuales escribió asiduamente sobre sus principales preocupaciones referentes a la población afrocostarricense. Se recuperan tres aspectos fundamentales en su obra: a) sus inquietudes nacionalistas y su lucha por la integración y (...) ciudadanía de los afrodescendientes, b) su relación y controversias con las ideas de Marcus Garvey y la Universal Negro Improvement Association (UNIA) y los ataques producto de su posición y c) la importancia que le brinda a la educación y a la formación intelectual de los jóvenes para el crecimiento de su cultura, por ejemplo, a través delClub Literario Alpha. En las conclusiones, se evidencia lo contradictorio y lo complejo de su pensamiento y de la diversidad y diferencias de la población afrocostarricense entre 1930-1938, sus ideas nacionalistas y patrióticas, así como la importancia de proseguir con este tipo de estudios, tanto del autor como de otros pensadores y pensadoras invisibilizados enla historia del Caribe costarricense. The paper engages Christopher Boorse’s Bio-Statistical Theory. In its current form, BST runs into a significant challenge. For BST to account for its central tenet—that lower-level part-dysfunction is sufficient for higher-level pathology—it must provide criteria for how to decide which lower-level parts are the ones to be analyzed for health or pathology. As BST is a naturalistic theory, such choices must be based solely on naturalistic considerations. An argument is provided to show that, if BST is to be preserved, such (...) parthood choices are based on non-naturalistic considerations. We demonstrate that even when parthood choices are based on the best way to preserve BST, there are counterintuitive results which bring the central tenet of BST into question. (shrink)

In _Time’s Causal Power_, Antonio Vargas explains how Proclus (412-485 C.E.) developed the unique theory that time is a cause and a god, the world’s first unmoved mover by addressing Aristotle’s criticisms of Plato’s claim that time is a change.

A satisfactory construal of the subject matter of free will debates must allow for disagreements along two axes. First, it must allow for the possibility of higher order disagreements, or disagreements about what concepts, phenomena, or practices an account of free will is supposed to capture or explain. Second, it must allow for the fact of variation in the extent to which theories are bound by antecedent pre-philosophical thought, talk, and practices. A promising way of accommodating these two thoughts is (...) to treat free will in broadly functionalist terms. On the account proposed here, free will is a power that makes sense of everyday responsibility practices. This construal is not widely shared, but it allows for the possibility that we might have false beliefs about the nature of free will, while still making sense of central philosophical debates about free will. Authenticity has become a widespread ethical ideal that represents a way of dealing with normative gaps in contemporary life. This ideal suggests that one should be true to oneself and lead a life expressive of what one takes oneself to be. However, many contemporary thinkers have pointed out that the ideal of authenticity has increasingly turned into a kind of aestheticism and egoistic self-indulgence. In his book, Varga systematically constructs a critical concept of authenticity that takes into account the reciprocal (...) shaping of capitalism and the ideal of authenticity. Drawing on different traditions in critical social theory, moral philosophy and phenomenology, Varga builds a concept of authenticity that can make intelligible various problematic and potentially exhausting practices of the self. Grief is often described as characterized by a particular emotional response to another person’s death. While this is true of paradigm cases, we argue that a broader notion of grief allows accommodating forms of this emotional experience that deviate from the paradigmatic case. The bulk of the paper explores such a nonparadigmatic form of grief, anticipatory-vicarious grief, which is typically triggered by pondering the inevitability of our own death. We argue that AV-grief is a particular moral emotion that serves a (...) unique function and is indissolubly linked to the practical identities of human agents. An agent’s AV-grief is about the harm that occurs to individuals whose practical identities depend on the agent. (shrink)

This chapter argues that despite the recent, welcome interest in autobiographical writing about depression, its use for research purposes presents an epistemological challenge because the extent to which these descriptions illuminate the true nature of depressive experience cannot be discerned. Contextualized within the genre of autobiography as well as the subgenre of illness memoir, the depression memoir exhibits ambiguities, it is shown, imposed by the constraints of its genre, and by the nature of autobiographical memory. Sources of ambiguity distinctive to (...) depression memoirs are next introduced, some tied to cultural meanings, others to the status of depressive states as constituted by moods. Finally, some empirical corroboration for these claims is cited, in findings indicating that depression affects autobiographical memory and writing style. The indeterminacy identified here is not a reason to dismiss depression memoirs, it is concluded, so much as to employ caution in drawing inferences from them. (shrink)

How do people understand the concepts of mental health and disorder? The objective of this paper is to examine the impact of several factors on people’s judgments about whether a condition constitutes a mental disorder or a healthy state. Specifically, this study examines the impact of the source of the condition, its outcome, individual valuation (i.e., the value the individual attaches to the condition), and group valuation (i.e., the value the relevant group attaches to the condition). While we find that (...) people’s health and disorder judgments are driven by perceived dysfunction, we also find that health and disorder judgments are impacted differently by these factors. Health judgements are impacted by outcome and individual valuation, and disorder judgments are impacted by condition source. These results suggest that the folk concept of mental health is positive (i.e., mental health is more than the absence of mental disorder) and normativist (i.e., value judgments play a significant role in determining whether a condition counts as healthy), while the concept of mental disorder aligns with a naturalist perspective, at least to the extent that dysfunction plays an important role in categorizing a condition as a disorder. However, our finding that people’s dysfunction judgments are influenced by individual valuation and outcomes poses a strong challenge to naturalist accounts. This paper aims to clarify the nature of understanding in medicine. The first part describes in more detail what it means to understand something and links a type of understanding (i.e., objectual understanding) to explanations. The second part proceeds to investigate what objectual understanding of a disease (i.e., biomedical understanding) requires by considering the case of scurvy from the history of medicine. The main hypothesis is that grasping a mechanistic explanation of a condition is necessary for a biomedical understanding of (...) that condition. The third part of the paper argues that biomedical understanding is necessary, but not sufficient for understanding in a clinical context (i.e., clinical understanding). The hypothesis is that clinical understanding combines biomedical understanding of a _disease_ or pathological condition with understanding _illness,_ which involves some degree of personal understanding of the patient. It is argued that, in many cases, clinical understanding necessitates adopting a particular second-personal stance and using cognitive resources _in addition_ to those involved in biomedical understanding. Naturalism, Interpretation, and Mental Disorder is an original new work focusing on the challenges we face when trying to interpret and understand mental illness. This study investigates the influence of evaluative judgments, specifically regarding an individual's moral character, on judgments of health and disease. Though it might seem that assessments judgments of health and disease should be impervious to evaluative judgments, two hypotheses suggest that health and disease judgments might be influenced by evaluative judgments: the "naturalization hypothesis" which centers on our inclination to assign blame, and the "pathologization hypothesis" rooted in the belief of a just world. These hypotheses lead to opposing predictions about (...) how someone with a perceived negative moral character might have their condition categorized. Employing a fictional vignette and the methodologies of experimental philosophy, our research provides evidence in favor of the "pathologization hypothesis." While this phenomenon likely carries real-world implications, especially in healthcare, it also has potential for offering insights into the dynamics of medicalization and stigma. (shrink)

While philosophical questions about health and disease have attracted much attention in recent decades, and while opinions are divided on most issues, influential accounts seem to embrace negativism about health, according to which health is the absence of disease. Some subscribe to unrestricted negativism, which claims that negativism applies not only to the concepts of health and disease as used by healthcare professionals but also to the lay concept that underpins everyday thinking. Whether people conceptualize health in this manner has (...) implications for medical care and public health, and so we set out to examine this claim in two studies. Participants were asked to assess and compare the health states of two people presented in two vignettes. We found that both lay people and medical students conceptualize health as something more than the absence of disease. We argue that our findings highlight a need to rethink unrestricted negativism and indicate a need to rethink the way the debate has traditionally focused on disease. (shrink)

Cognitive theory (CT) is currently the most widely acknowledged framework used to describe the psychological processes in affective disorders like depression. The purpose of this paper is to assess the philosophical assumptions upon which CT rests. It is argued that CT must be revised due to significant flaws in many of these philosophical assumptions. The paper contains suggestions as to how these problems could be overcome in a manner that would secure philosophical accuracy, while also providing an account that is (...) better suited to explaining some of the cognitive, emotional, and bodily manifestations of affective disorders. Between the mid-1960s and the early 1970s, the quotidian dimension took political centrality in Japan thanks to the leading role of the New Left movement and its ideology. This went hand in hand with an appreciation of the philosophical approaches of Marxist intellectuals such as Jun Tosaka and Gorō Hani, who saw the quotidian as a fundamental space for historical transformation. We know how Tosaka and Hani developed an everyday-centred philosophy of history through their writings, but we know little about (...) how formats other than the written word – such as cinema – contributed to thinking historical reality from the same ideological approach. To address this gap in our understanding, this article analyses the intersection of two highly representative films with Tosaka and Hani’s historical thought: Secrets Within Walls ( Kabe no naka no himegoto, Kōji Wakamatsu, 1965) and Ceremonies ( Gishiki, Nagisa Ōshima, 1971). These films’ cinematic allegorisation of post-war Japan’s everyday relationships was a way to reflect on the political character of that period. (shrink)

We sometimes fail unwittingly to do things that we ought to do. And we are, from time to time, culpable for these unwitting omissions. We provide an outline of a theory of responsibility for unwitting omissions. We emphasize two distinctive ideas: (i) many unwitting omissions can be understood as failures of appropriate vigilance, and; (ii) the sort of self-control implicated in these failures of appropriate vigilance is valuable. We argue that the norms that govern vigilance and the value of self-control (...) explain culpability for unwitting omissions. (shrink)

El artículo reconstruye los intereses lectores y de instrucción obrera, y también los textos escritos por los obreros y obreras a través de Hoja Obrera, periódico de publicación semanal, el cual pertenecía a la Sociedad de Trabajadores, en el período comprendido entre 1909 y 1912. De tal manera, que detalla cuáles fueron los escritores y escritoras leídos, qué textos leyeron, cuáles fueron sus preocupaciones por la instrucción obrera y la lectura, así como quiénes escribían y sobre qué escribían. La metodología (...) se basó en la profundización de Hoja Obrera, entre el 17 de octubre de 1909 y el 8 de abril de 1912, con un total de 94 ejemplares analizados. Se concluye tres aspectos fundamentales: primero, la importancia brindada por los obreros y obreras a la instrucción y a la lectura como medio para fomentar su formación intelectual y poder comprender las condiciones sociales y culturales de la sociedad costarricense; segundo, la influencia de escritores como Émile Zola, Joaquín Dicenta, Victor Hugo, Lev Tolstói, Félix Matos Bernier, entre otros, en el entendimiento de las relaciones humanas; tercero, el aporte de la escritura como una forma de denuncia de estas condiciones, principalmente a través de la poesía como medio de expresión artístico. To build cultures of peace, one must often lay aside the "expert" label and become a student in the world who is willing to learn from other cultures in pursuit of peace. To set up an intercultural dialogue on this topic, the Committee for the Psychological Study of Peace, in conjunction with the University for Peace and the Institute for Psychological Research of the University of Costa Rica, sponsored the 6th International Symposium on the Contribution of Psychology to Peace. This (...) special issue extends the dialogue which began at the Symposium. Aiming to help define the role and contributions of psychologists in building cultures of peace, the articles in this issue address: *topics relating to human rights; *how psychologists can contribute to democratization; *how psychology has much to say on the causes and dynamics of intolerance and the processes of building tolerance in the context of intergroup relations; *how psychology can contribute to understanding and fostering nonviolence; *how cultures of peace will not be possible without a concerted effort to bring about global environmental security and that our failure to restore environmental health is fundamentally a psychological problem; and *psychologically informed policies for the promotion of cultures of peace, including the importance of gender equity. Nomy Arpaly rejects the model of rationality used by most ethicists and action theorists. Both observation and psychology indicate that people act rationally without deliberation, and act irrationally with deliberation. By questioning the notion that our own minds are comprehensible to us--and therefore questioning much of the current work of action theorists and ethicists--Arpaly attempts to develop a more realistic conception of moral agency.

There is a phrase by Paul Klee that insists and repeats itself in Deleuze's writing: "We are missing this last force. We are missing a people". However, the contemporary world is defined precisely by the fullness and the becoming population of peoples. This is why the concept of people constitutes an amphibology that is revealed in Deleuze's work as an appearance between people and thought. In this sense, the relationship between both concepts shows a set of aesthetic, political, and ontological (...) consequences that these notes attempt to address in Deleuze's thought and beyond. Hay una frase de Paul Klee que insiste y se repite en la mano de Deleuze: “Nos falta esta última fuerza. Nos falta un pueblo”. Sin embargo, el mundo contemporáneo se define justamente por el lleno y el devenir población de los pueblos. Es por esto que el concepto de pueblo constituye una anfibología que se revela en el trabajo de Deleuze como una comparecencia entre pueblo y pensamiento. En este sentido, la relación entre ambas categorías muestran un conjunto de consecuencias estéticas, políticas y ontológicas que estas notan intentan abordar en el pensamiento de Deleuze y más allá de éste.
